VNU, LLC — engageLIVE — PRIVACY POLICY
When you use our services, you trust us with your information you willingly submit when playing our games or answering our questions. We understand this is a big responsibility and work hard to protect your information and put you in control.
This Privacy Policy is meant to help you understand what information we collect and why we collect it.
Effective June 25, 2019
We build a range of applications which help people engage and interact at LIVE events with their favorite sports, teams, leagues, concert artists, movie distributors, sponsors and brands. This type of LIVE engagement is designed to explore and interact with the world and the LIVE events we attend and the brands and sponsors who make such happen in new and creative ways. Our services include:
- eLIVE engageLIVE (a utility ‘engagement’ tool)
- Cloud Platforms like our eLIVE Venue, eLIVE Nanolytics, eLIVE Scheduler and our eLIVE Creator
- Our tools and software can be integrated into third-party apps, sites, and content (like advertisements) and embedded into different types of engagement promotions.
Our overall privacy policy is easy. We do not capture where you surf, who you chat with, or even websites you visit on the Internet. We do not care about such things. We work to give you a voice and a way to express your voice and opinions securely. For example, you will notice that generally, we DO NOT list engagement questions and answers on your mobile device. You only see the engagement questions we ask on the Jumbotrons or media systems at the LIVE events we enable. Plus you will notice the choices you can make are displayed on those same multimedia screens, but not on your mobile device, thus what we are collecting is literally “this phone’s clicks in response to the questions displayed on the Jumbotron (i.e. 1, 2, 3, 4, or A, B, C, D, etc.) and then we perform a simple mathematical equation so you can see how you compared to others doing the very same engagement you did. For example: 25% Voted “A” and 40% Voted “B” and 35% Voted “C”. That’s it. We’re just collecting a series of Alphas or Numerics or Symbols, and so on.
INFORMATION WE COLLECT
We want you to really understand the types of information we collect as you use our free engagement tools and software.
We collect information to provide better services to all our clients and users — from figuring out basic stuff such as do people like A+B+C choices better than 1+2+3 choices? Would people rather engage with games to see if they win or if they have selected the correct answer, or do people like just seeing how they compare to others at LIVE events. The information we collect and share with the venues and sponsors or brands is only the information you personally and willingly submit when you push a button. If you do not like the question asked or the corresponding answers or options; then simply don’t cast your vote or opinion for that particular engagement.
Once you engage with us our software, technology assigns you a unique identifier in our database — we do this and use unique technology and patents so IF you win something or we need to run a gift that you’ve won to your seat; we can find you. This simply helps us maintain your unique identification across all LIVE events where you might continue to use our tools.
Things you create or provide to us
If you elect to create a Digital Wallet within our system, so we can gift you coupons and such, you have the ability to provide us with personal information that might include your name, zip code, email and a password for you to access your digital coupons. You can also choose to add a phone number for example IF you are in a “STANDING AREA ONLY” and don’t have an assigned section, row and seat identifier. We need a way to find you IF you win a prize so we can bring it to you. Your phone number will be used to text you and make your phone screen light up a special color so you can wave it and our ushers and they can find you in the throngs of the crowd.
We also collect the content you create, and by that we mean, when you post a vote or answers you are literally creating content that says “I (user ID#) answered this way and I am willingly sending you my answer. In some instances we might have a user selfie contest and will prompt you to “snap a selfie” because we might put your face on the Jumbotrons for tens of thousands to see. Thus, IF you choose to snap a selfie at that moment, you are agreeing to both create and share content created by you with us. It is really that simple. Don’t want to have your photo on the Jumbotrons for tens of thousands to cheer? Then don’t take a selfie. Either way YOU have full control not us.
Information we collect as you use our services
Your apps, browsers & devices
In relation to the apps, browsers and devices you use to access our tools, software and games, we do have the ability to collect information about them, which helps us provide features like automatic product updates to our services.
Your activity
We collect information about your utilization of our services, which we use to do things like figure the best prizes to award you, what types of things you like to win, what types of products you best respond to and what types of games get you to engage the most. The activity information we collect may include:
- How fast or slow you make a choice selection
- How many times you engaged during a particular LIVE event
- Whether you like game styled engagements or multiple choice style engagements better
- Voice and audio information when you use audio features
- What types of brands or brand offerings you like or respond to the most
- What your votes or choices are for particular sponsors, brands, teams, offerings, services or promotions
- What type of LIVE events you like the most or attend the most
- What types of discounts and offers do you like to redeem that we have sent you
Your location information
We collect information about your location when you use our services, which help us confirm your answers and display your choices based on the actual LIVE event and it’s exact location. For example: take the “get your selfie on the jumbotron” engagement — if you win, it better be at the LIVE event where you are, not some random stadium or venue somewhere else . Your location can be determined with varying degrees of accuracy by:
- GPS
- Sensor data from your device
- Information about things near your device, such as Wi-Fi access points, cell towers, and Bluetooth-enabled devices
The types of location data we collect depend in part on your device and account settings. For example, you can turn your mobile device’s location on or off using the device’s settings app; again YOU have total control over that information, not us.
WHY WE COLLECT DATA
We use data to build better services, build better engagements, attract sponsors who are the ones giving you the prizes and gifts, and so on.
We use the information we collect via all of our services for the following purposes:
To provide our services
We use your information to deliver our services to our clients by showing them that people love to engage, interact and win prizes at LIVE events, and that if sponsors, brands, teams, leagues and advertisers will offer great prizes then fans like you will engage with the brand and answer simple, easy-to-understand questions; in turn so sponsors, brands, teams, leagues and advertisers can develop better offerings and savings for you in the future. We complete the two-way cycle. Your votes and answers allow those companies who want to offer you prizes and/or rewards understand what it will take to get your business in the future.
To maintain & improve our services
We also use your information to ensure our services are working as intended, such as tracking outages or troubleshooting issues that you report to us or engagements you prefer, as well as to make improvements to our services.
To develop new services
We use the information we collect from existing services to help us develop new ones. For example, understanding which engagement styles the fans most like will, help us develop new ones and keep our games and engagement fresh, new and interesting. Besides, how many times have you seen the same old boring dot race at a baseball game where the winner is predetermined? Yuck, Tired, Old and Outdated (you know like the types of games your father played as a kid!).
To provide personalized content and ads
Again, we use your information to deliver our services to our clients by showing them that people love to engage, interact and win prizes at LIVE events, and that if sponsors, brands, teams, leagues and advertisers will offer great prizes then fans like you will engage with the brand and answer simple, easy-to-understand questions; in turn so sponsors, brands, teams, leagues and advertisers can develop better offerings and savings for you in the future. We complete the two-way cycle. Your votes and answers allow those companies who want to offer you prizes and/or rewards understand what it will take to get your business in the future.
And one more time (we promise), we use the information we collect from existing services to help us develop new ones. For example, understanding which engagement styles the fans most like will, help us develop new ones and keep our games and engagement fresh, new and interesting.
To measure performance
We use data for analytics and measurement to understand how you responded and how you used our services. For example, we analyze data about your votes and engagements with LIVE events so we can do things like optimizing product design. And we also use data about the ads you interact with to help advertisers understand the performance of their ad campaigns.
To communicate with you
If for any reason we collect your email address, it is to interact with you directly or to send you something directly from a sponsor or advertiser first through us. It you want to continue to dialog or engage with a sponsor or advertiser after that, then you have that choice.
To protect us, our users, and the public
We use information to help improve the safety and reliability of our services. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues that could harm our users, the public, or our company.
SHARING YOUR INFORMATION
When you share your information
Our services let you share information with other people in the same venue or LIVE event you are attending. This way everyone can see how he or she compares with others. Don’t worry, no-one sees that YOU shared that vote, but that within this LIVE event, 25% Voted A and 40% Voted B and 35% Voted C. That’s it. Remember, you have control over WHETHER you share or not. Click a vote choice when you are choosing to share, don’t click an answer when you don’t want to share. It really is that simple.
When we share your information
We do not share your personal information such as: This is Sally Jane Gunn and she is 25 years old. We will never share information like that. We do share information such as: A typical female 19 to 25 year old voted this way: 25% Voted A and 40% Voted B and 35% Voted C etc. That’s it!
For legal reasons
We will share personal information outside of our company if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:
- Meet any applicable law, regulation, legal process, or enforceable governmental request, but then again what would be revealed? Only that “Sally loves the blue dot in the baseball race the most since she selects that same choice each time she plays?”
- Enforce applicable Terms of Service, including investigation of potential violations.
- Detect, prevent, or otherwise address fraud, security, or technical issues.
- Protect against harm to the rights, property or safety of our company, our users, or the public as required or permitted by law.
We absolutely share non-personally identifiable information with our partners — like publishers, advertisers, developers, or rights holders, teams, leagues, sponsors, brands and so on. For example, we share information to show trends about the general use of our services. We also allow specific partners to collect information from your engagement activities. Think of it this way: if an advertiser is offering a prize they are doing so in hopes you will answer a question for them.
If our company is involved in a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information as well as, give all of our users notice before personal information is transferred or becomes subject to a different privacy policy.
KEEPING YOUR INFORMATION SECURE
We build security into all of our services & systems to protect your information, and as such, we’ve created a secure engagement ecosystem where none of your personal information or your votes and activity reside on the same server at any one time. In fact, we ourselves have to jump through an ungodly amount of security hoops to be able to reassemble your data.
The insights we gain from maintaining our services and continuously protecting your information helps us detect and automatically block security threats from ever reaching you. And if we do detect something risky that we think you should know about, we’ll notify you and guide you through steps to stay better protected.
COMPLIANCE & COOPERATION WITH REGULATORS
We regularly review this Privacy Policy and make sure that we process your information in ways that comply with it.
Data transfers
Your information may be processed on servers located outside of the country where you live. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply the same protections described in this policy. We also comply with certain legal frameworks relating to the transfer of data, such as the EU-US and Swiss-US Privacy Shield Frameworks. In short: If it’s the law we are fully compelled to comply with the letter of the law. No shortcuts.
